By accessing or using the Hey Made With Ai platform ("Platform"), operated by Hey Made With Ai ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

We reserve the right to update these terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated terms.

Hey Made With Ai provides an AI-powered content generation platform that allows users to create images, videos, and other media using artificial intelligence models. The Platform is available via subscription and credit-based plans.

To use the Platform, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

• You must be at least 18 years old to use the Platform.
• One account per person. Creating multiple accounts to circumvent bans or limits is prohibited.
• You are responsible for all content generated using your account.
• You must notify us immediately at hello@heymadewithai.com if you suspect unauthorised access to your account.

By using the Platform and submitting prompts, you automatically grant Hey Made With Ai a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, and display the prompts and generated outputs you create on the Platform. This includes using them for improving our services, showcasing Platform capabilities, marketing, and generating our own content.

Use of the Platform constitutes acceptance of this license. You may opt out by contacting hello@heymadewithai.com but continued use of the Platform after opting out will be considered re-acceptance.

The Platform operates on a credit system. Credits are purchased and consumed when generating content. Credits are non-transferable between accounts.

• Credits have no cash value and cannot be exchanged for money except as provided in our Refund Policy.
• We reserve the right to change credit pricing at any time.
• Bonus credits awarded through promotions or gifts are non-refundable.
• We are not responsible for credits lost due to user error.

You agree not to use the Platform to generate content that:

• Is illegal, harmful, threatening, abusive, harassing, or defamatory.
• Infringes any intellectual property rights of any third party.
• Contains sexually explicit material involving minors.
• Promotes violence, discrimination, or hate speech.
• Is designed to deceive, defraud, or mislead others.
• Violates any applicable laws or regulations.

Violation of these rules may result in immediate account suspension or permanent ban without refund.

Subject to the license granted in Section 4, you retain ownership of the prompts you submit. The AI-generated outputs are provided to you under a limited, non-exclusive license for personal and commercial use, subject to these Terms.

The Platform itself, including its design, code, and branding, is the intellectual property of Hey Made With Ai. You may not copy, reproduce, or reverse-engineer any part of the Platform.

The Platform integrates third-party AI generation models (including but not limited to models from Replicate and their respective providers). Use of these models is subject to their own terms and policies. We make no warranty regarding the outputs produced by third-party models.

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

AI-generated content may sometimes produce inaccurate, unexpected, or inappropriate results. You are responsible for reviewing and using any generated content appropriately.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEY MADE WITH AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

Our total liability to you for any claims arising from these Terms or the Platform shall not exceed the amount you paid us in the three months preceding the claim.

We reserve the right to suspend or terminate your account at any time, with or without cause and without notice. Upon termination, your right to use the Platform ceases immediately.

These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions.
